With the changes that have been made in family court procedure, the national statistics say that 80% of family court cases are seen where either one party or both parties are going into court without an attorney.

For the most part, the slash and burn tactics that most family court lawyers used in years past are no longer a standard part of the process. There is now two areas of focus that encourage attorneys for both sides to work together. First, there is mediation and arbitration at the beginning of the court process. This often works best without the involvement of attorneys, simply because of the attorney client system. Attorneys are paid by the hour. Why would they want to close the deal quickly? On the other hand, the arbitrator or mediator is strictly there to "close the deal." The goal of the mediation process is to allow the give and take of mediation to negotiate an arrangement that's good for both parties involved. Along with this new approach is the main question on a judge's mind when discussing family settlements that involve children--what is best for the children involved. So, with those two areas of focus in mind, a family court process can work for everyone--whether they have money for a high-priced attorney or not.
